EMOTE TOS:
• The following terms are key points that apply to emote commissions. Please see my full terms of service for additional info & full conditions~
• If you have any questions please let me know <3• I retain full copyright and ownership of the artwork, and may use it in my portfolio, on social media, etc.
• You may use the emotes for personal, non-commercial use.
• A commercial use license is available for an additional fee (this may be purchased during the commission process, or any time in the future if you decide~)
• USE ON MONETIZED TWITCH & YOUTUBE CHANNELS DOES NOT REQUIRE A COMMERCIAL USE LICENSE!• Payment is required in full, via Artistree, prior to work beginning on your commission.
• NO REFUNDS once work has begun• Designs may be simplified for emote readability purposes.• Included Revisions:
• • Two (2) Revisions during the draft phase.
• • One (1) Minor Revision during final approval (*revisions that require a re-draw or major alteration will require an additional fee)
• Additional revisions will be charged a fee depending on the complexity of the request.• Files will be delivered as PNG in 4 sizes with a DPI of 300

• ❌ You (nor anyone else) may not alter, reproduce, trace, or modify the emotes in any way without explicit permission, unless strictly for animation purposes. ❌
• ✅ You (or another artist) may alter an emote strictly for animation purposes, regardless of if you purchased layer separation & cutting from me~ ✅• You are responsible for your emotes following YouTube / Twitch Emote Guidelines! Emotes rejected or removed due to a guideline violation will NOT receive free / extra revisions to fix any guideline or moderation violations!

• Terms of service are subject to change at any time.
• The following outlines the agreement between you, the client, and me, the artist. These terms are applicable to any and all commission projects. Special considerations, alterations, or other amendments may apply depending on the type of commission. These amendments will be specified during the commission request process, as applicable.• In the context of these terms, “You” refers to the client commissioning the artwork – “I” or “Me” refers to the artist providing the service.For agency use, or specialized projects, please contact me to discuss amended terms to better fit your usage• By commissioning me, you agree to these terms. Please review them carefully. Amendments to the terms will be communicated to you in writing if applicable.- - - - -// COPYRIGHT AND OWNERSHIP• I retain full copyright and ownership of all commissioned artwork unless otherwise agreed upon in writing.
• I may use the artwork in any way, for any purpose (e.g., displaying in a portfolio, social media, streaming/video content, etc).- - - - -// LICENSE TO USE• Upon delivery of final files, you are granted a non-exclusive, non-transferable license for personal, non-commercial use.
• This license is not granted to drafts, sketches, wip, or material other than the final delivered files unless otherwise specified.- - - - -// COMMERCIAL USE• A Commercial Use License must be purchased/granted to use the commissioned artwork for commercial purposes (e.g., merch, monetized digital products, etc)• A Commercial Use License may be purchased at any time both during the order process, or after completion/delivery.• If you are unsure if you require a Commercial license, please reach out to me directly for clarification on your use case.Note: A commercial use license is -not- required in certain scenarios, such as using emotes on a monetized Twitch/YouTube channel, etc. Permitted applications or exceptions of commercial use will be explicitly noted when applicable.- - - - -// PROHIBITED USE• NO AI: You -MAY NOT- use the artwork with/as a part of/in any AI capacity, including but not limited to: Training models, generative tools, or any AI related services (this also includes the use of the art in prompts for any AI service, or uploading to a platform that may be known to use content for AI related activities)• NO NFT/BLOCKCHAIN: You -MAY NOT- use the artwork in any way related to NFTs or Blockchain technologies.• NO INAPPROPRIATE CONTENT: You -MAY NOT- use the artwork in any harmful, hateful, illegal, discriminatory, or any other way or for any purpose that may be seen as inappropriate.• No Alterations or Reproduction
• • Artwork may not be modified, reproduced, traced, or “completed” from drafts/wip, etc, in any way without explicit permission.• No Resale or Redistribution
• • Selling or redistributing artwork in any form (e.g. giveaways, bundles, etc) is strictly prohibited without explicit permission.• No Third-Party Modification
• • Another artist may not modify, reproduce, trace, use pre-final files, or work with the artwork in any way without explicit permission unless following the animation exception guideline below.• Animation Exception
• • If the artwork is ordered with layer separation & cutting, you or another artist may use the files solely for animation. Any modifications outside of the scope of what is strictly necessary for animation purposes are prohibited.
• • If the artwork is not ordered with layer separation & cutting, you or another artist may modify the delivered artwork strictly for animation purposes only, such as making the necessary alterations to properly separate & cut the layers as needed, or other modifications to facilitate the animation process. This exception is limited to animation purposes only.
• • In the event that you or a third party animations a commissioned artwork, you or the third party may not claim ownership of the original design. The final product must remain bound by these terms, and does not permit the sale, distribution, commercial use, or any other restricted or prohibited use for projects that include the original design in any form.Note: Violations of prohibited uses, or other “bad-faith” actions will result in the immediate cancellation, without refund, of any ongoing commission, as well as the immediate and irreversible revocation of your rights and license to use any artwork you may have received up to this point. Further actions may be taken as applicable, such as blacklisting and/or legal action.- - - - -// COMMISSIONING FOR OTHERS• You may commission artwork for/on behalf of someone else.• The recipient is bound by the same terms and licenses. Once delivered to the third party, you transfer and waive all rights and license to use the artwork.• You are responsible for delivering the artwork, and for informing the recipient of these terms.** Note: Please let me know if you are commissioning artwork for someone else so that I may keep a record of ownership & be able to respond should the recipient reach out to me in the future.- - - - -// CREDIT & ATTRIBUTION• You may not claim or misrepresent yourself or anyone else as the creator of the artwork.• Proper attribution is required when sharing the artwork publicly unless otherwise specified. Proper attribution includes my handle (LillyKu) and an appropriate link to a social profile / site, as applicable (e.g., tagging when sharing on Twitter, linking to my site when attributing on YouTube, etc)• Attribution Info:

• • Bluesky: @LillyKu.bsky.social** Note: I understand it might not always be applicable or possible to include credit in a convenient format, but I appreciate a best-effort attempt whenever possible.- - - - -// RIGHT TO DECLINE / CANCEL• I reserve the right to decline or cancel a commission at any time, for any reason.• Commissions may be canceled for inappropriate behavior, including but not limited to: harassment, spam, payment disputes, non-responsiveness, or otherwise unprofessional conduct. No refunds will be granted in these cases• NO REFUNDS - ALL COMMISSIONS ARE NON-REFUNDABLE (unless specified explicitly in the exceptions below, or provided to you in writing with your commission request)• Artist Cancellation:
• • A refund will be granted if I cancel a commission before work begins.
• • A refund will be granted in the event where I am unable to complete the commission due to circumstances beyond my control, such as personal injury/illness, loss of work, or technical issues. In such cases you will be notified as soon as possible that I am unable to continue work, and your refund option will be discussed. This refund option is only applicable if I am completely unable to fulfill the commission in any way.
• • • If a scenario in which I am able to provide partial fulfillment of an order, or an alternative resolution is agreed upon rather than a full cancellation (such as resuming after a reasonable delay), an agreement specific to your order may be discussed and agreed upon in writing.• Client Cancellation:
• • A refund will be granted if you cancel a commission before work has begun. If you have been notified that work has started, you will no longer be entitled to this option.• Cancellation Process:
• • Cancellations by either party will stop all work immediately. Upon cancellation, the commission will be closed and may not be reopened.
• • Upon cancellation, your rights and license to use the artwork will be immediately revoked unless otherwise specified in the exceptions below.
• • No files will be delivered for cancelled commissions unless otherwise specified in the exceptions below.
• • Cancellation Exceptions:
• • • In the event that I am unable to complete a commission due to circumstances outside of my control, such as personal injury/illness, loss of work, or technical issues, considerations will be made in my best effort to accommodate you. If applicable, partial fulfillment may be possible if agreed upon by both parties. In the event of a partial file delivery, altered terms will be provided which may replace any or all of those specified here.- - - - -// CLIENT UNRESPONSIVENESS:• In the event that you become unresponsive for an extended period of time, the commission may be paused or canceled without refund.• You are responsible for informing me if you will have an extended duration in which communication may not be possible. I’m more than happy to work with you to fit your schedule or pause your commission should you have a situation that makes communication difficult for a reasonable duration.• In the event that you do not respond in a timely manner during initial contact/communication to set up your commission, your request may be pushed to the back of the queue.• In the event that you are not able to make the initial payment for your commission within a reasonable time, your commission may be cancelled and your slot forfeited.• Once a commission has been accepted and work has begun, if you do not respond to communication related to your commission for an extended period of time the following may be enforced:• • 1 Week: Your commission will be paused. A paused commission is subject to delay.• • 2 Weeks: Your commission may be stopped and moved to the back of the queue. A stopped commission may experience significant delay.• • 4 Weeks: Your commission may be canceled without refund.• • • A cancellation due to lack of response is non-refundable.• • • No files will be delivered.• • • No additional contact will be attempted beyond the notice of cancellation.- - - - -// PAYMENT TERMS• Payment must be made in full prior to work beginning.• Special Orders: Payment plans or alternate terms may be available for larger/special commissions. If you are in need of arranging a payment plan to fit your needs, please contact me, I’ll be more than happy to try to figure out something that works for you!- - - - -// COMMISSION PROCESS• References & Detail:
• • You must provide all necessary references for your commission.
• • Complex designs may incur additional fees.• • In some instances, designs may be modified to better fit the intended use of the artwork (e.g., emote designs may be simplified to be more readable at small sizes, etc)• Revisions:
• • Included revisions may vary depending on your project. If your commission is subject to a different revision schedule, it will be specified on the order/request page and communicated to you prior to work beginning.• • Included:
• • • Two (2) revisions during the draft phase.
• • • One (1) minor revision after completion/final file delivery, within one week of the delivery of the completed commission. (*Revisions that require re-drawing, altering the design, etc, after final deliver are considered major revisions and may incur an additional fee.• • Additional Fees: More than two revisions during the draft phase, major changes, or revisions requested beyond the included duration after delivery (1 week) will incur additional fees.• • Revision fees will vary depending on the complexity of the request. You will be informed of any fees before proceeding!• • **Note: It is your responsibility to ensure that artwork complies with the terms of service of the platform on which you use it. I am not responsible for any moderation actions taken against your usage of artwork. Artwork that may infringe upon the terms of service of a platform is NOT entitled to free or additional revisions for compliance (e.g., if you commission an emote, it is your responsibility to ensure it is appropriate for usage on Twitch/YouTube. If the emote is removed due to a violation, you are -not- entitled to a free or additional revision to fix this issue after the fact. Any revisions for this purpose will be subject to a revision fee as usual).• File Delivery:
• • Final files will be delivered within a ZIP file, shared via the commission platform or via file sharing link.
• • Specific file types/formats and sizes are dependent on the type of commission and will be specified on the order/request form. If you have specific needs for your files please let me know before work begins. File resolution/dimensions may not be possible to change once work has begun.• File Retention:
• • Source and delivered files are retained for a reasonable period (minimum one week after final delivery). File availability is not guaranteed beyond this point.
• • Original / Source & Delivered Files: Will be retained for a reasonable amount of time. A best effort will be made to retain these files, however I do not guarantee to retain these beyond the one-week revision period following final delivery. In the event that source files are no longer available, revisions may not be possible for a prior commission.
• • Uploaded Files: A best effort will be made to ensure uploaded files remain available to you for a reasonable amount of time. Uploaded files are not guaranteed to remain accessible for an extended period of time. I am not responsible for files hosted online, nor for the actions of a platform upon said files (e.g., files are removed due to a service expiring or shutting down, timed removal of items, items removed due to moderation, etc).• A best effort will be made to ensure that you have access to your files, however I am not liable for the loss of access to any files. I am not obligated to provide further support or action regarding the files beyond initial delivery.• It is your responsibility to retrieve delivered files in a timely manner. It is your responsibility to maintain your own copy and access of delivered files.- - - - -// PLATFORM TOS• It is your responsibility to ensure that the artwork complies with the terms of service of any platforms in which you use it (e.g., following Twitch emote guidelines, etc). I am not responsible for any rejections, removal, or other issues related to platform moderation. Items subject to moderation actions are not entitled to free revisions.- - - - -// ENFORCEMENT OF TERMS• Failure to comply with these terms may result in the cancellation of the commission and revocation of your usage rights. I reserve the right to take further action, such as legal recourse, if necessary.
